ChaCha Toolbar End User License Agreement (EULA)
If you download, install or use this software ("ChaCha Toolbar") you agree to be bound by this EULA. If you do not agree to these terms, you should not download, install or use the ChaCha Toolbar.

License for Personal Non-Commercial Use
The ChaCha Toolbar is licensed to you for your own personal non-commercial use only.
You may make one back up copy of the ChaCha Toolbar in its installable form.
You may not distribute or resell the ChaCha Toolbar, but you should feel free to encourage your friends and family to download their own copies from ChaCha.com.

Restrictions
The follow restrictions apply to your use of the ChaCha Toolbar:
* You may not use the ChaCha Toolbar to damage, crash, or overload ChaChas system or services.
* You may not reverse engineer the ChaCha Toolbar.

Web Site Terms of Use and Privacy Policy
ChaCha Toolbar is for use solely with ChaCha's search services. By using the ChaCha Toolbar, you also agree to ChaChas web site Terms of Use and its Privacy Policy. You can read them by clicking on these links. They can also be found from links on each page at ChaCha.com.

Your Feedback
At ChaCha, we welcome your comments and suggestions (Feedback) which you can send to chacha.com/info/feedback. You agree that Feedback becomes ChaChas property and that ChaCha can use Feedback as it deems fit.

Intellectual Property
The ChaCha Toolbar belongs to ChaCha and its suppliers. This EULA grants license rights only. You are not permitted to alter the ChaCha Toolbar or to disable or remove any proprietary legends of ChaCha or others.

Disclaimer of Warranties
THE CHACHA TOOLBAR IS PROVIDED "AS IS". CHACHA AND ITS SUPPLIERS EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
YOU DOWNLOAD, INSTALL AND USE THE CHACHA TOOLBAR AT YOUR OWN RISK. CHACHA AND ITS SUPPLIERS HAVE NO RESPONSIBILITY FOR ANY DAMAGES OR LOSS THAT MAY RESULT.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.

Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL CHACHA AND ITS SUPPLIERS BE LIABLE ON ACCOUNT OF THE CHACHA TOOLBAR.
CHACHA AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Miscellaneous
This EULA is governed by the substantive laws of the State of Indiana and applicable US federal law. You agree to comply with US laws on export control. You and ChaCha agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Indianapolis Indiana USA with regard to any case or dispute arising from this Agreement or its subject matter.
No waiver of provision of this EULA will be effective unless in writing and signed by ChaCha.
This EULA is the entire agreement between the parties.
